Hiring in Poland: match contractors and employees to the delivery role

Key takeaways
Assess who directs the work and sets its time and place.
Separate an accepted specialist deliverable from continuing delivery capacity.
Budget remuneration, administration and the selected arrangement's additional costs.
Review the engagement when duties or supervision change.
Buying a rollout-readiness assessment differs from hiring a daily delivery coordinator. The project sponsor must specify the work, the working relationship and the budget before choosing how to engage a Poland-based specialist.
Teams preparing to hire in Poland should begin with that role description. A defined handover may suit independently organized work; continuing coordination under a manager's direction calls for an employment assessment. The project end date alone does not decide the worker's status.
A readiness review and a continuing delivery role buy different work
Consider two hypothetical assignments for a three-month rollout. One buys a defined review; the other buys continuing coordination.
Independent readiness review
Scope: a specialist assesses rollout dependencies, produces a dependency and risk register, recommends corrective action and hands over the findings. The specialist organizes the review independently.
Acceptance: the sponsor checks the agreed coverage and findings against written acceptance criteria. A request to investigate another business unit goes through a scope change.
Benefit: the buyer defines the output and completion point before committing the budget.
Tradeoff: the handover ends the assignment. Continuing ownership of the register requires an internal owner or a separately agreed engagement.
Continuing delivery coordination
Scope: a coordinator follows managerial priorities and schedules, updates dependencies as plans change and participates in the team's ongoing work.
Accountability: the manager assigns duties and directs performance across the delivery period. The role needs an employment assessment and the relevant employer administration.
Benefit: the team has continuing capacity to track unresolved actions and respond to changing priorities.
Tradeoff: the budget owner must plan utilization and employment costs even when the workload varies.
In this example, the reviewer flags an unresolved supplier dependency for the sponsor to address. The coordinator keeps following that dependency as part of continuing assigned duties. That difference belongs in the role description.
Checking the quality of a promised result differs from directing how someone works each day. A deadline, milestone payment or recurring invoice does not independently establish legal status. Match the agreement to the working arrangement that the project actually requires.
Polish employment status depends on how the work is performed
Article 22 of Poland's Labour Code describes employment through paid work of a specified kind for an employer, under its direction and at the time and place it designates. Where those conditions apply, a different contract name does not change the employment relationship; substituting a civil-law agreement in those conditions is prohibited.
In the hypothetical review, the sponsor should assess how independently the specialist organizes the investigation alongside the agreed output. If the specialist subsequently follows a manager's daily priorities and designated hours, the original description needs reassessment.
Polish business-to-business (B2B) self-employment, often through a sole proprietorship known as JDG, is distinct from employment and from other civil-law arrangements. Business registration does not settle the status of the relationship. Nor does an accepted report automatically identify the correct civil-law contract.
An employee route requires clarity about the legal employer and who administers employment obligations. A Polish entity is not always a prerequisite: foreign employers can have a direct-employment registration route. Its feasibility depends on the employer's jurisdiction and applicable Polish registration, insurance and tax obligations.
An Employer of Record (EOR) arrangement instead uses a provider as the legal employer. Confirm who signs the employment agreement and carries each duty. Where the structure supplies staff through an agency, assess Polish temporary-agency rules and restrictions. A provider's advertised Polish coverage does not establish the legality of a particular staffing arrangement.
Build two three-month budgets with every cost assigned
Use these hypothetical planning amounts in Polish złoty (PLN). They are assumptions, not market wages or supplier quotations:
Review: a business buyer commissions an independently organized readiness deliverable from a Polish specialist, directly or through an accepted subcontracting arrangement. Assumed remuneration: PLN 30,000.
Coordination: a legal employer employs a Poland-based coordinator for three months. Assumed gross salary: PLN 10,000 monthly. Remuneration subtotal: 3 × PLN 10,000 = PLN 30,000.
Each PLN 30,000 figure covers remuneration alone. The deliverable and the staffed capacity are different purchases, so these examples cannot establish savings.
Give each route its own worksheet. Use the following additions, with a quoted amount or a declared assumption for every entry:
C — contributions: applicable buyer-side or employer contributions, confirmed for the actual arrangement. Do not automatically add the contractor's own taxes and contributions to the buyer's costs; establish who bears them and what the fee includes.
A — administration: platform, payroll administration or EOR charges for the selected service. Record the charging unit, base and exclusions.
S — setup: incremental equipment, access and setup costs. Assume zero only if existing resources cover the assignment without additional spend.
T — travel: assume zero if both assignments are remote with no reimbursed travel; otherwise obtain a travel allowance.
B — benefits and cover: quote incremental benefits or absence cover. Use zero only where no additional cost is planned or due.
V — value-added tax (VAT): ask accounting to confirm the nonrecoverable amount for the selected arrangement.
X — currency costs: quote conversion and currency charges. A PLN budget does not establish that a provider charges in PLN.
R — reserve: assign a sponsor-approved allowance for scope changes and arrangement-specific exit costs.
Use each route's own quoted values or assumptions in these formulas:
Review budget: PLN 30,000 + C_review + A_review + S_review + T_review + B_review + V_review + X_review + R_review.
Coordination budget: PLN 30,000 + C_employee + A_employee + S_employee + T_employee + B_employee + V_employee + X_employee + R_employee.
Keep unquoted entries pending before approving either total. Employee deductions from gross salary are already within that salary; ordinary paid leave is not another full salary addition. Include separately required settlements or incremental cover in the relevant entry. Check for overlapping charges: equipment included in a service fee should not be counted twice.
Put scope changes through a sponsor approval checkpoint
Attach a short decision record to the project approval. It should describe the arrangement clearly enough for another sponsor to review it:
Accountable sponsor: name the person approving the work and changes.
Scope and supervision: record the output or continuing duties, who sets priorities and who controls working arrangements.
Dependencies: identify required inputs and their owners, such as supplier access for the review.
Acceptance owner: specify who accepts the report or assesses the continuing role's performance.
Access and handover: assign access approval, handover recipients and access removal.
Parties: identify the contracting parties or legal employer and the service provider's responsibilities.
Budget owner: name who reconciles the full formula and obtains outstanding quotes.
Review date: set the next checkpoint and the changes that bring it forward.
If the independent reviewer becomes a daily coordinator, the sponsor should reassess the relationship before extending it on unchanged assumptions. Recurring new duties, imposed working hours or an expanded budget also trigger review. Update the role, responsibility record and cost approval together. This record organizes project governance; it does not establish independent status or replace the assessment of actual working conditions.
Three providers to check after selecting the engagement route
For an independent readiness review, compare contracting structure, documents and fee basis. These three services offer Polish contractor operations, subject to acceptance of the engagement. Confirm the proposed service scope and complete quote before selection.
Structure: the client contracts with 4dev.com, which engages subcontractors through its Contractor Platform. Poland appears in its contractor country list.
Workflow: the platform verifies onboarding, records tasks and statuses, and automates supporting documents. Confirm the document set for the proposed review.
Fee: usage-based service charge. Obtain the rate, chargeable base, currencies, taxes and funding, withdrawal or conversion costs in writing.
Limit: it has no employee EOR or employee-payroll role. Its documentation cannot make employer-directed work independent. Check the buyer's and specialist's eligibility alongside the assignment.
Remote
Structure: ordinary Contractor Management is available for Poland. The client retains the contractor agreement.
Workflow: localized contracts and invoice approval fit a buyer managing the specialist relationship directly.
Fee: a monthly charge for contractors actively worked with that month. Obtain the applicable fee, funding, contractor currency-conversion and withdrawal costs, taxes and extras.
Limit: the client remains responsible for its contractor relationship. Remote's separately advertised Polish EOR service requires a different employment and responsibility review; it is not included in this contractor arrangement.
Deel
Structure: Deel offers Polish contractor administration; the ordinary agreement remains between client and contractor.
Workflow: Deel administers signing, collects invoices and documents, and manages payments. Milestone contracts release the predetermined payment after approval, which fits a defined review handover.
Fee: a monthly service charge per contractor. Obtain the applicable fee, funding, currency and withdrawal costs, taxes and extras.
Limit: the client remains the counterparty, and Deel does not mediate contractor disputes. Its separately advertised Polish employee/EOR service is a different engagement route. Milestone approval does not determine legal status.
Questions before the project sponsor approves the role
Does a three-month project make the worker a contractor?
No. A short duration does not establish independent status. Polish Article 22 concerns the actual paid work, employer direction and designated time and place, regardless of the contract's name.
Does JDG registration settle status?
No. JDG identifies a sole proprietorship. The relationship still needs assessment against actual working conditions; business registration does not override employment characteristics.
Is a Polish entity always required to employ someone?
No. Foreign employers can have a direct-employment registration route. Check the employer's jurisdiction and applicable Polish registration, insurance and tax duties before choosing it.
Can a contractor platform take on the legal-employer role?
Contractor administration does not supply the legal-employer role. For a directed employee position, identify the employer and its duties; 4dev.com operates on the contractor side.
When should the sponsor review a changed role?
Review it when a specialist takes on daily coordination, recurring new duties or imposed hours, or when the approved budget changes. Reassess the working relationship and update scope, parties and cost approval before continuing on the original assumptions.
